1. Purpose

These terms govern the use of the Céphée app, published by Nicolas Saurel, a sole trader operating under the trade name appserre (see the legal notice). By installing and using Céphée, you accept them.

2. What Céphée is, and what it isn't

Céphée is a personal diary that helps you record your migraines and look at your own data. It is not a medical device.

If you have unusual pain or in an emergency, call 112 (or your local emergency number).

3. Access to the app

Céphée runs on Android 8 or later, in French, English and Spanish. It works without an account and without an internet connection, except to buy or check a subscription.

4. Trial, subscription and lifetime purchase

5. Right of withdrawal

For digital content supplied immediately, EU and French law provide that the 14-day right of withdrawal no longer applies once performance has begun with your express consent and your acknowledgement that you lose this right (article L.221-28, 13° of the French Consumer Code). The free trial lets you try the whole app before paying.

6. Your data and backups

Your data is saved only on your phone (see the privacy policy). Only you can back it up: remember to export your data regularly or to turn on automatic backup. A forgotten export or backup password cannot be recovered, and the corresponding file then remains unreadable. We cannot restore data lost with a phone.

7. Liability

We do what is needed for Céphée to work properly and calculate its statistics accurately from what you enter. However, we cannot guarantee that it is entirely error-free or that it works on every device. We are not liable for a health decision based solely on the app, nor for data loss caused by the loss, theft, failure or reset of your phone.

Nothing in these terms limits the rights the law gives you as a consumer, in particular the legal guarantee of conformity for digital content and services.

8. Changes to the app and the terms

Céphée evolves through updates (fixes, new features). If a change significantly alters these terms, you will be told in the app before it applies.

9. Intellectual property

The app, its name, icon and texts belong to appserre. You have a personal, non-commercial right of use. The data you enter belongs to you.

10. Governing law and disputes

These terms are governed by French law. If there is a problem, please write to us first at info@appserre.fr: we will look for an amicable solution.

You may also use a consumer mediator free of charge; their details will be given on this page as soon as one is appointed. Failing agreement, the dispute may be brought before the competent courts.
